Maison de Porcelaine Sàrl — a Swiss-registered limited liability company, holding the Maison de Porcelaine brand and serving as the headquarters of the business.
LE KIM OÜ — an Estonian-registered company, operating the European fulfillment and operations office located in Paris, France.

Throughout these Terms, "we," "us," "our," and "the Maison" refer collectively to Maison de Porcelaine Sàrl and LE KIM OÜ, as the case may be. "You" and "your" refer to the customer placing an order.

3. Eligibility

To place an order through our Site, you must:

Be at least 18 years of age, or the legal age of majority in your jurisdiction;
Have the legal capacity to enter into a binding contract;
Provide accurate, complete, and current information when placing your order.

We reserve the right to refuse service to anyone for any lawful reason at our reasonable discretion.

4. Personal Use Only

Our products are intended exclusively for personal, non-commercial use. Resale, redistribution, or commercial exploitation of products purchased through our Site is strictly prohibited.

We reserve the right to refuse or cancel any order that we reasonably believe is placed for the purpose of resale or commercial distribution, including but not limited to: bulk orders, unusually high quantities, or repeat orders matching reseller patterns.

5. Product Information & Availability

We strive to present accurate descriptions, ingredient lists, photographs, and pricing on our Site. However:

Photographs are illustrative. Actual products may vary slightly in appearance due to lighting, screen calibration, or supplier updates.
Stock is limited and not guaranteed. We may restrict quantities per customer, per order, or per region at our reasonable discretion.
Errors may occur. In the event of typographical errors, pricing errors, or inaccurate product information, we reserve the right to correct such errors and, where appropriate, cancel orders placed at incorrect prices. In such cases, you will be promptly notified and offered the option of placing a corrected order or receiving a full refund.

6. Pricing & Taxes

All prices displayed on the Site are in the currency relevant to your shipping destination (EUR, CHF, or GBP).

EU customers: Prices displayed include applicable VAT. No additional customs fees apply at delivery (shipped from within the EU).
UK customers: For orders £135 or less, UK VAT (20%) is included in displayed prices. For orders over £135, UK VAT and customs handling fees are applied at delivery by the carrier.
Swiss customers: For orders below approximately CHF 62, no import VAT applies (Swiss de minimis rule). For orders of CHF 62 or more, Swiss import VAT (8.1%) and a customs handling fee are applied at delivery by the carrier.

We reserve the right to modify prices at any time. The price applicable to your order is the price displayed at the time of order submission.

7. Order Process & Acceptance

When you place an order through our Site:

You will receive an automated order confirmation email. This confirms receipt of your order but does not constitute acceptance of the contract.
A binding contract is formed only when we dispatch the ordered products from our fulfillment partner. You will receive a separate shipping confirmation email at that point.
We reserve the right to refuse or cancel any order, in our reasonable discretion, including but not limited to: stock unavailability, pricing errors, suspected fraud, breach of these Terms, or any other lawful reason.

If we cancel an order after payment has been processed, the full amount will be refunded to the original payment method within a reasonable timeframe and without undue delay.

8. Payment

We accept major payment methods as displayed at checkout.

Payment is processed at the time of order placement. By submitting payment information, you represent and warrant that you are authorised to use the selected payment method.

All payments are processed through secure third-party payment providers. We do not store full payment card details on our systems.

9. Shipping & Delivery

Shipping fees, delivery timelines, and dispatch terms are governed by our Shipping & Delivery Policy, which forms an integral part of these Terms.

10. Returns, Refunds, and Statutory Right of Withdrawal

Returns, refunds, and statutory withdrawal terms are governed by our Return & Refund Policy, which forms an integral part of these Terms.

In summary:

All sales are final. We do not accept returns or refunds on opened or used products.
Damaged or defective items: Contact us within 7 days of delivery to arrange replacement or refund.
EU and UK consumers retain their statutory right to withdraw from the purchase of unopened, sealed products within 14 days of delivery, under applicable consumer protection law. This right does not apply to opened, used, or unsealed products. Return shipping costs are the customer's responsibility for statutory withdrawals.

11. Intellectual Property

All content on our Site — including but not limited to text, photography, illustrations, logos, design elements, product descriptions, the "Maison de Porcelaine" name, the "Porcelaines" brand vocabulary, and our related visual identity — is the exclusive property of Maison de Porcelaine Sàrl and/or its licensors, and is protected by Swiss, EU, UK, and international intellectual property laws.

You may not reproduce, distribute, modify, publicly display, transmit, or commercially exploit any content from our Site without our prior written consent.

Product imagery, ingredient information, and brand descriptions of our curated brands (d'Alba, Abib, Dr.Solution, Vitamin U, Vegetology, and others) are used under license or supplier-authorised distribution. All trademarks of curated brands remain the property of their respective owners.

12. User Conduct

You agree not to:

Use our Site for any unlawful purpose;
Attempt unauthorised access to any portion of our Site, servers, or systems;
Engage in fraudulent activity, including chargeback fraud, false refund claims, or use of stolen payment methods;
Misrepresent your identity or provide false information;
Use our Site in any manner that could damage, disable, overburden, or impair its functionality;
Use automated means (bots, scrapers, etc.) to access or interact with our Site without our prior written consent.

We reserve the right to suspend or terminate access to our Site, and to cancel orders, for any user found to be in breach of these Terms.

To the maximum extent permitted by applicable law:

Our total liability arising out of or in connection with any order is limited to the amount you paid for the relevant order.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, loss of goodwill, or loss of data.

Nothing in these Terms limits or excludes our liability for:

Fraud or fraudulent misrepresentation;
Death or personal injury caused by our negligence;
Any liability that cannot be limited or excluded under applicable consumer protection law in your country of residence.

14. Warranties & Disclaimers

We make no representations or guarantees regarding individual skincare results, which may vary based on skin type, condition, usage patterns, and individual response. Products are sold subject to the statutory warranties applicable under Swiss, EU, and UK consumer law.

Allergies and sensitivities: If you have known allergies, skin sensitivities, or are pregnant or breastfeeding, please review ingredient lists carefully and consult a qualified dermatologist or healthcare professional before use.

15. Data Protection & Privacy

Your personal data is processed in accordance with our Privacy Policy, which complies with:

The EU General Data Protection Regulation (GDPR) for customers in the European Union;
The Swiss Federal Act on Data Protection (revFADP) for Swiss customers;
The UK Data Protection Act 2018 and UK GDPR for UK customers.

Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, please cease using our Site.

17. Governing Law

These Terms are governed by the laws of Switzerland, without regard to its conflict of law principles.

Notwithstanding the above: if you are a consumer resident in the European Union or the United Kingdom, you retain the protection of the mandatory consumer protection laws of your country of residence, which cannot be derogated from by contract.

18. Jurisdiction

Subject to applicable mandatory consumer protection law:

The competent courts of Geneva, Switzerland, have exclusive jurisdiction over disputes arising from or in connection with these Terms.
EU consumers retain the right to bring proceedings in the courts of their country of residence, in accordance with EU Regulation 1215/2012 (Brussels I bis).
UK consumers retain the right to bring proceedings in the courts of their country of residence, in accordance with applicable UK law.

19. Dispute Resolution & Online Dispute Resolution (ODR)

We aim to resolve all disputes amicably and promptly. If you have a complaint:

We will acknowledge receipt within 5 business days and aim to resolve the matter within 30 days.

We are not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration board but may choose to do so on a case-by-case basis.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

21. Entire Agreement

These Terms, together with our Shipping & Delivery Policy, Return & Refund Policy, and Privacy Policy, constitute the entire agreement between you and the Maison concerning the purchase of products from our Site, and supersede all prior or contemporaneous communications, whether oral or written.
