1. Introduction & Scope

Welcome to Maison de Porcelaine. These Terms of Service ("Terms") govern your access to and use of:

Any mobile applications we may offer;
Any related services, features, and community functions (such as reviews, Q&A, ratings, and user-generated content).

Collectively, these are referred to as the "Site" or "Platform."

Throughout these Terms, "we," "us," "our," and "Maison de Porcelaine" refer collectively to LE KIM OÜ and Maison de Porcelaine Sàrl, as applicable. "You" and "your" refer to the user of the Site.

3. Eligibility

To use the Site, you must:

Be at least 18 years of age, or the legal age of majority in your jurisdiction;
Have the legal capacity to enter into a binding agreement;
Use the Site in compliance with applicable laws and these Terms.

6. User-Generated Content

The Site may allow you to submit reviews, ratings, photographs, comments, Q&A, and other content ("User Content").

6.1 Ownership

You retain ownership of all User Content you submit.

6.2 Licence

By submitting User Content to the Site, you grant Maison de Porcelaine a non-exclusive, worldwide, royalty-free, transferable, and sublicensable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with:

The operation, promotion, and marketing of the Site and our products;
Internal business purposes (such as service improvement, quality control, and customer support);
Communications across our marketing channels (including our website, social media, email, and printed materials).

This licence continues for the duration of your User Content's publication on the Site and for a reasonable period thereafter, to allow archival and reference purposes.

6.3 Your Representations

By submitting User Content, you represent and warrant that:

The content is your original work, or you have all necessary rights and permissions to submit it;
The content does not infringe upon any third party's intellectual property, privacy, publicity, or other rights;
The content is accurate, lawful, and not misleading;
The content does not contain illegal, defamatory, obscene, threatening, abusive, hateful, or discriminatory material;
You will not submit content that violates applicable laws or regulations.

6.4 Right to Removal

We reserve the right (but have no obligation) to review, edit, refuse, or remove any User Content at our discretion, including content that violates these Terms or applicable law.

6.5 Right to Deletion (GDPR / FADP)

You may request deletion of your User Content at any time by contacting info@maisondeporcelaine.com. We will action such requests in accordance with applicable data protection law (GDPR / Swiss FADP / UK GDPR).

7. Intellectual Property

7.1 Our Content

All content on the Site — including but not limited to text, photography, illustrations, logos, design elements, product descriptions, the "Maison de Porcelaine" name, the "Porcelaines" brand vocabulary, our visual identity, and the design and layout of the Site itself — is the exclusive property of Maison de Porcelaine Sàrl and/or its licensors, and is protected by Swiss, EU, UK, and international intellectual property laws.

Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, distribute, modify, publicly display, transmit, sell, or commercially exploit any content from the Site without our prior written consent.

7.2 Limited Licence to You

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes, subject to these Terms.

7.3 Third-Party Trademarks

Product imagery, ingredient information, and brand descriptions of our curated brands (d'Alba, Abib, Dr.Solution, Vitamin U, Vegetology, and others) are used under licence or supplier-authorised distribution. All trademarks of curated brands remain the property of their respective owners.

7.4 Intellectual Property Complaints

If you believe content on the Site infringes your intellectual property rights, please contact info@maisondeporcelaine.com with:

A description of the work claimed to be infringed;
The location (URL) of the allegedly infringing material on the Site;
Your contact information and a statement of good-faith belief that the use is not authorised;
A statement under penalty of perjury that the information is accurate and that you are authorised to act on behalf of the owner.

We will investigate and respond in accordance with applicable law.

8. Privacy & Data Protection

Your personal data is collected, processed, and stored in accordance with our Privacy Policy, which complies with:

The EU General Data Protection Regulation (GDPR) for customers in the European Union;
The Swiss Federal Act on Data Protection (revFADP) for Swiss customers;

Any purchase of products through the Site is governed by our Terms of Sale, which form an integral part of these Terms. The Terms of Sale set out our policies regarding order acceptance, pricing, payment, shipping, returns, and refunds.

12. Disclaimers & Warranties

The Site and its content are provided "as is" and "as available," to the maximum extent permitted by applicable law.

We do not warrant that:

The Site will be uninterrupted, error-free, or free of viruses or harmful components;
The information on the Site is always accurate, complete, or current;
Skincare results from our products will be uniform across individuals;
Third-party content or services accessed through the Site will be reliable or accurate.

Nothing in this section limits or excludes any statutory warranty or right that cannot be excluded under applicable consumer protection law in your country of residence (including, for EU consumers, the rights granted under the Consumer Sales Directive).

13. Limitation of Liability

To the maximum extent permitted by applicable law:

Our total liability arising out of or in connection with your use of the Site is limited to the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or €100, whichever is greater.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, loss of goodwill, loss of data, or business interruption.

Nothing in these Terms limits or excludes our liability for:

Fraud or fraudulent misrepresentation;
Death or personal injury caused by our negligence;
Any liability that cannot be limited or excluded under applicable consumer protection law in your country of residence.

14. Indemnification

You agree to indemnify, defend, and hold harmless Maison de Porcelaine Sàrl, LE KIM OÜ, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of:

Your breach of these Terms;
Your User Content;
Your violation of any law or third-party right;
Your misuse of the Site.

This indemnification obligation does not apply to the extent that any claim arises from our own negligence or wilful misconduct.

15. Modifications to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this document reflects the most recent version.

Material changes will be communicated to registered users via:

Email to the address associated with your account, where applicable;
A prominent notice posted on the Site for at least 30 days before the changes take effect.

Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, please cease using the Site and, if applicable, delete your account.

16. Suspension & Termination

We may suspend or terminate your access to the Site (in whole or in part) at our reasonable discretion, with or without prior notice, if:

You breach these Terms or any policy referenced herein;
You engage in unlawful, fraudulent, or harmful activity;
We are required to do so by law or order of a competent authority;
We discontinue all or part of the Site.

Upon termination, all provisions of these Terms that by their nature should survive termination (including IP, indemnification, limitation of liability, and governing law clauses) shall remain in effect.

17. Governing Law

These Terms are governed by the laws of Switzerland, without regard to its conflict of law principles.

Notwithstanding the above: if you are a consumer resident in the European Union or the United Kingdom, you retain the protection of the mandatory consumer protection laws of your country of residence, which cannot be derogated from by contract.

18. Jurisdiction

Subject to applicable mandatory consumer protection law:

The competent courts of Geneva, Switzerland, have exclusive jurisdiction over disputes arising from or in connection with these Terms.
EU consumers retain the right to bring proceedings in the courts of their country of residence, in accordance with EU Regulation 1215/2012 (Brussels I bis).
UK consumers retain the right to bring proceedings in the courts of their country of residence, in accordance with applicable UK law.

19. Dispute Resolution & Online Dispute Resolution (ODR)

We aim to resolve all disputes amicably and promptly. If you have a complaint:

We will acknowledge receipt within 5 business days and aim to resolve the matter within 30 days.

For EU customers: The European Commission provides an online dispute resolution platform, available at:

You may submit any unresolved dispute through this platform. Our registered email address for ODR purposes is info@maisondeporcelaine.com.

We are not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration board but may choose to do so on a case-by-case basis.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

21. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Terms of Sale, Shipping & Delivery Policy, and Return & Refund Policy, constitute the entire agreement between you and Maison de Porcelaine concerning your use of the Site, and supersede all prior or contemporaneous communications, whether oral or written.
